Charge: Leaving the Scene Causing Property Damage

Details: My client was operating a delivery van for Amazon when, after dropping off a package, he backed out of a residential driveway onto a heavily trafficked roadway. The homeowners maintained a small, portable fence near the entrance of their driveway, designed to be moved into place to prevent vehicles from entering while children were present in the area. While backing out, my client’s van made contact with the small fence, causing damage. Due to its small size, my client was unaware that any contact had occurred. The homeowners subsequently discovered the damage and, through review of security footage, identified the vehicle as belonging to Amazon. When interviewed by police, my client acknowledged having made a delivery at that location but stated he had no awareness of having struck the fence.

The matter proceeded to a Clerk Magistrate’s Hearing. I presented my client’s educational background and employment history, along with a detailed account of the circumstances surrounding the incident. I introduced photographs depicting both the fence and the roadway to illustrate the conditions my client faced. I emphasized that my client’s attention was reasonably focused on safely reversing a large commercial van onto a major roadway, a maneuver complicated by the vehicle’s lack of rear windows. Based on these circumstances, I argued that it was entirely plausible my client remained unaware he had made contact with the homeowners’ property, and that probable cause for a criminal charge was therefore lacking.

The Clerk agreed to divert the case from the main criminal session and declined to issue a criminal complaint. The homeowners will be contacted, and should repairs be needed, my client will cover the associated costs. My client’s clean record remains intact.

Result: Charge dismissed prior to arraignment.

Ayer District Court

Charges: Expired Registration, Lack of Insurance, Speeding

Details: My client was driving a vehicle which he purchased out of state and was waiting for Massachusetts registration and insurance documents to be finalized when he was pulled over for speeding. My client is a business owner, drives for work, and could not suffer any infractions on his driving record. I worked with my client to obtain valid registration and insurance and represented him at a Clerk Magistrate’s Hearing. The Clerk dismissed all charges against my client.

Framingham District Court

Charge: Negligent Operation of a Motor Vehicle

Details: My client was driving and dropped his cell phone on the car floorboard. When he tried to reach down and locate his phone, he struck a street sign and then a tree. No other cars were involved in the collision, and no parties were injured. The Town did not respond to a request for payment of the replacement sign. The case was heard at a Clerk Magistrate’s Hearing and dismissed.

Barnstable District Court

Charge: License Suspended, Subsequent Offense

Details: My client did not have a license due to a requirement that he pay child support. He eventually was able to obtain his license and, despite having several prior convictions for suspended license, the case was dismissed.

Brockton District Court

Charges: OUI, Negligent Operation

Result: Both charges dismissed at Clerk Magistrate’s Hearing, prior to arraignment

Concord District Court

Charge: Leaving the Scene Causing Personal injury

Result: Found Not Guilty in a Trial by Jury

Woburn District Court

Charges: Two counts of Disturbing the Peace, one count of Failing To Stop For Police

Result: All charges dismissed prior to trial

Brockton District Court
